Rules for the Party debate and election of delegates to the XXII Congress of the PCP
I – Plenary Assemblies
Plenary assemblies to debate documents and elect delegates shall be convened by the respective leadership bodies, which shall take charge of the proceedings.
The higher bodies must take the necessary measures to convene and ensure the holding of the organisations' plenary assemblies whenever they learn that the respective leadership bodies have failed to do so.
Party members from the respective organisations shall participate in the proceedings and decisions of plenary assemblies.
In the case of Party members who belong to more than one organisation, the organisation in which they normally pay their dues shall be considered for the purposes of paragraph 3.
Those directly responsible for these organisations, even though they are not formally part of them, may take part in the proceedings of plenary assemblies without the right to vote, except as provided for in paragraph 20 of these Rules. Members of higher organisations may also take part in plenary assemblies, without the right to vote, when they have been invited.
Plenary assemblies whose objectives include the election of delegates must be convened at least 8 days in advance. The notice of the meeting must state its purpose.
The members who Chair the plenary assemblies will draw up minutes to be sent to the Central Committee Secretariat by December 2, in which they will record a summary of the general direction of the debate, as well as the results of the votes, accompanied by the forms with data of the elected delegates
II – Debate
The documents proposed by the Central Committee for debate and decision by the XXII Congress should be discussed at meetings of the different Party bodies and organisations and at plenary assemblies.
Party members have the right to express their opinions and submit proposals, including amendments to the documents presented by the Central Committee, which should be sent by the organisation to which they belong or on their own initiative, to the Secretariat or the Political Committee of the Central Committee.
Plenary assemblies, if they so decide, may vote as a whole on the draft documents presented by the Central Committee.
The Central Committee will finalise the debate and approve the documents that will be presented for discussion and decision by the Congress.
The documents approved by the Central Committee will be presented to the Congress accompanied by information and an assessment of the broad sense of the proposed amendments tabled in the course of the debate, including those not accepted by the Central Committee.
III – Election of Delegates
The Congress will be made up of delegates elected directly by the plenary assemblies and delegates by inherence.
The delegates elected by the organisations will be chosen in the proportion of 1 delegate per 60 Party members.
The number of delegates to be elected by the regional organisations, in accordance with paragraph 14, shall be distributed taking into account the various organisations that make them up and their proportionality.
Organisations with fewer than 60 but more than 30 Party members may elect one (1) delegate at their plenary assembly, provided that the proportion of one (1) delegate per 60 Party members in the respective regional organisation as a whole is not exceeded by more than 10%.
In the case of organisations with fewer than 60 Party members, the bodies immediately above them, in order to ensure that all Party members have the right to elect and be elected as delegates to the Congress, may convene plenary assemblies by grouping together different organisations, respecting the proportion defined in paragraph 14.
Organisations calling plenary assemblies for the election of delegates must table candidates for election as delegates. Party members participating in plenary assemblies may table candidates for delegates. The number of delegates elected as full delegates should be paired by an equal number of alternate delegates who, in order of election, will take the place of the full delegates who are unable to attend the XXII Congress.
Delegates, except in cases where it is necessary to bring several organisations together, or to apply the provisions of paragraph 20 of these Rules, must be elected at plenary assemblies of the organisations to which they belong. No member of the Party may vote or be a candidate for delegate (full or alternate) in more than one plenary assembly.
Participants in the plenary assemblies of their organisations have the right to elect and be elected as delegates. At plenary assemblies, Party members who are directly responsible for their organisation may also elect and be elected as delegate
Participants in the plenary assemblies convened for the election of delegates who consider that the regulations have not been complied with and that the democratic nature of the election has not been ensured, in accordance with the norms laid down in these Rules, may appeal to the body with higher responsibility in the respective organisation, which must, in good time, appreciate the grounds for the complaints and rectify the irregularities if they are confirmed. Members who do not agree with the decision may also appeal to the Central Control Commission.
IV – Delegates by inherence
Delegates by inherence are the members of the Central Committee, members of the Central Control Commission and members of the Party belonging to the National Board of the JCP. Other Party members may also be delegates, up to a maximum of 1% of the total number of delegates to the Congress, to whom the Central Committee, on its own initiative or at the proposal of organisations, deems it appropriate to attribute this status, taking into account the nature of the party tasks they perform.
V – Calendar
The documents adopted by the Central Committee for debate in the Party will be published in «Avante! ».
Plenary meetings may be held once the documents have been published.
Proposals for alterations and amendments to the documents presented by the Central Committee for debate throughout the Party should be submitted as early as possible, with the deadline for submission being November 25.
Plenary assemblies for the election of delegates will be held by December 1.
VI – First Session of the XXII Congress
The XXII Congress will culminate the debate that will take place throughout the Party.
It is compulsory to present a delegate's card and an up-to-date Party card to enter the area reserved for delegates.
The Congress will function when the majority of delegates are present.
The Chair, which will be responsible for starting the proceedings of the Congress, will be made up of the General Secretary and members of the executive bodies of the Central Committee.
The members of the Central Control Commission take their seats in the Presidency at the beginning of the Congress.
The Rules of Procedure of the Congress will then be put forward for discussion. The rest of the proceedings of the Congress will be carried out in accordance with the approved Rules of Procedure.
